Terms of Service

1. Acceptance of Terms

These Terms govern your access to and use of the Service. By creating an account, accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

You may use the Service only if you:

• Are at least 18 years old (or the age of legal majority in your jurisdiction).
• Have the legal capacity to enter into a binding contract.
• Use the Service in compliance with these Terms and all applicable laws and regulations.

We may refuse access to the Service or terminate accounts at our sole discretion.

3. Description of the Service

The Service provides an online platform where users can publish, browse and manage property listings for sale or rent and communicate with each other.

We are not a party to any transaction between users. We do not own, manage, control or guarantee any of the properties listed on the Service, and we do not act as a real estate broker, agent, financial advisor or insurer.

4. User Accounts

To access certain features, you may need to create an account and provide accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Promptly updating your information when it changes.

You must notify us immediately at info.rushapp@gmail.com if you suspect unauthorized use of your account.

5. User Content

5.1 Definition

"User Content" means any content you submit, upload, post, publish or otherwise make available on or through the Service, including property listings, photos, descriptions, prices, messages and feedback.

5.2 Your responsibilities

You are solely responsible for your User Content. In particular, you agree that:

• All information in your listings is accurate, complete, up-to-date and not misleading.
• You have the necessary rights and authorizations to publish the listings.
• Your User Content does not infringe any third-party rights (including copyright, trademarks, privacy or other rights).
• Your User Content complies with applicable real estate, advertising, consumer protection and anti-discrimination laws.

We do not systematically review or verify User Content and we are not responsible for any errors, omissions or misleading information provided by users.

5.3 Prohibited content

You agree not to upload or publish content that:

• Is illegal, fraudulent, defamatory, obscene, hateful or discriminatory.
• Contains spam, malware or other harmful code.
• Violates the privacy or rights of others.
• Contains unauthorized personal data of third parties.
• Attempts to circumvent our rules, policies or technical protections.

We may remove or restrict access to User Content at our sole discretion if we believe it violates these Terms or applicable law.

6. License to User Content

By providing User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, reproduce, host, store, display, adapt (for formatting purposes), distribute and otherwise make your User Content available on the Service for the purposes of operating, promoting and improving the Service.

This license remains in effect for as long as your User Content is available on the Service. Certain copies (such as backups) may be retained for a limited period after deletion, as permitted by law.

7. Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose.
• Impersonate any person or entity or falsely claim an affiliation.
• Interfere with or disrupt the Service or servers (e.g. via bots, scraping, flooding or overloading).
• Reverse engineer, decompile or attempt to extract the source code of the Service, except as allowed by law.
• Circumvent or attempt to circumvent security or access controls.

8. Listings, Prices and Transactions

• We do not guarantee that any listing is available, accurate or correctly priced.
• All negotiations and agreements regarding properties are solely between users.
• We are not responsible for the quality, safety, legality or suitability of any property.
• We are not responsible for any payments, deposits, contracts or other obligations between users.

You are solely responsible for verifying information, performing due diligence and obtaining independent professional advice before entering into any transaction.

9. Paid Services and Fees

We may offer optional paid services, such as promoting or highlighting listings. The applicable fees, features and conditions will be described at the time of purchase.

• Unless otherwise stated, fees are non-refundable once the service has been provided.
• We may change our fees or introduce new paid services at any time, without retroactive effect.
• Any applicable taxes (including VAT) may be added to the price according to law.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the Service will be uninterrupted, secure or error-free, or that any content or information obtained through the Service will be accurate, complete or reliable.

11. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill.
• Our total aggregate liability for any claim relating to the Service shall not exceed the greater of: (a) the total amount you paid us for paid services during the twelve (12) months preceding the event giving rise to the claim, and (b) €100.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless RushApp OÜ, its directors, employees and partners from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your use of the Service.
• Your User Content.
• Your violation of these Terms or applicable law.
• Your violation of any rights of a third party.

13. Intellectual Property

The Service and all materials therein (excluding User Content) are protected by copyright, trademark and other intellectual property laws and are owned or licensed by us.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal or internal business purposes in accordance with these Terms. You may not copy, modify, distribute, sell or lease any part of the Service without our prior written consent.

14. Termination

We may suspend or terminate your account or access to the Service at any time, with or without notice, if:

• You violate these Terms or applicable law.
• We are required to do so by law or by a competent authority.
• We decide to discontinue the Service (in whole or in part).

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Estonia, unless mandatory law provides otherwise.

16. Changes to These Terms

We may modify these Terms from time to time. The updated version will be posted on https://rnb.ee and will indicate the "Last updated" date at the top. By continuing to use the Service after the updated Terms take effect, you agree to be bound by them.
